4-1-2: APPLICATION FOR LICENSE OR PERMIT:
Except as otherwise provided, an applicant for license or permit required by the provisions of this code shall make and file an application, in writing, with the finance officer on the form from time to time prescribed by the city finance officer.
   A.   Unless otherwise provided, an application for license or permit shall state:
      1.   Name and address of applicant.
      2.   Trade name, if any, under which license or permit is to be exercised.
      3.   If a partnership, the name and address of each partner.
      4.   If a corporation or LLC, the names and addresses of the principal officer(s) or manager(s).
      5.   Place of business or location where the license or permit is to be exercised.
      6.   Description of the activity to be carried on under the license or permit.
      7.   Such information as required by this code or other ordinance or by the city council showing the applicant to be entitled to the license or permit and that he/she is a proper person and the place a proper place for exercise thereof.
      8.   Such information as required by this code or other ordinance as may be necessary for determination of the amount of the license or permit fee.
   B.   Except as otherwise provided, an applicant for license or permit shall first pay the amount of the license or permit fee to the finance officer, taking his/her receipt therefor, showing the kind of license or permit for which the fee was paid and the amount paid. Such receipt shall be presented to the licensing or permitting officer if other than the finance officer to whom application for the license or permit is made. (Ord. 2444, 7-15-2013)
4-1-3: ISSUANCE; CONDITIONS OF LICENSE OR PERMIT:
   A.   Issuance By Finance Officer: Except as otherwise provided, all licenses and permits shall be issued by the finance officer. If the issuance of the license or permit is approved by a licensing and permitting authority other than the finance officer the applicant shall provide proof of compliance with all requirements for issuance of the license or permit, including conforming to the zoning regulations of the city, to the issuing authority. If the use for which a license or permit is applied for is a nonconforming use under the zoning regulations, no license or permit shall be issued. Unless otherwise provided, all licenses and permits shall be signed by the finance officer or deputy finance officer and shall have affixed thereto the official seal of the city.
   B.   Approval Of License Or Permit By The City Council: If the license or permit is subject to approval by the city council the approval or disapproval shall be entitled in the official minutes of the city council. No document constituting the license or permit shall be issued.
   C.   Bond, Insurance Or Deposit: Any bond, liability insurance or deposit required shall be subject to the approval of the city council, and in case the city council deems the security inadequate, it may require new or additional security.
   D.   Term Of License Or Permit: Unless otherwise provided, all licenses and permits shall take effect when issued and shall terminate on December 31 in the year for which issued. Except as otherwise provided, the fee charged for the license or permit shall be paid on the basis of a full year.
   E.   License Or Permit To Be Exhibited: Every person to whom a license or permit is issued by the city shall exhibit the license or permit if requested by a law enforcement officer or any person who may deal with the license or permit when reasonably requested to do so.
   F.   Change Of Business Name: If a licensee or permittee changes the name or form of organization under which he/she does business, the license or permit may be so changed without payment of an additional fee, except as otherwise provided by law. (Ord. 2444, 7-15-2013)
4-1-4: EXEMPTIONS:
The provisions of this chapter as to licensing and permitting certain activities shall not apply to those conducted as a part of the established Corn Palace Week Festival. (Ord. 2444, 7-15-2013)
4-1-5: REVOCATION OF LICENSE OR PERMIT:
The city council shall have power to cancel and withdraw any license or permit issued by the city for failure of the licensee or permittee to comply with any ordinance or regulation of the city or state law respecting such license or permit or the manner of exercise thereof or for other good cause after hearing upon notice to the licensee or permittee.
Upon conviction of a violation of any provision of this code or other ordinance of the city by a licensee or permittee relating to the exercise of such license or permit, the court, in addition to other penalties imposed, may enter its judgment canceling such license or permit. 4-1-6: APPEAL PROCEDURES:
Any applicant aggrieved by the refusal of a city official to issue a license or permit or by the revocation of a license or permit shall have the right to appeal the official's decision to the city council. Such appeal shall be requested by submitting a written request to the city finance officer within five (5) days of the action from which the appeal is taken. The city council shall consider the appeal at its next regularly scheduled meeting occurring at least five (5) days following, at which time the applicant shall be entitled to present his/her appeal orally or in writing.
