9-8-1: PURPOSE AND APPLICATION:
   A.   It is the desire of the city to encourage development that enhances the environmental and aesthetic conditions that contribute to the quality of life in the city. To achieve this, a minimum standard for a landscaped setback and landscape features are prescribed to lessen the adverse effects common to commercial property.
   B.   This chapter shall apply to all commercially zoned property improved with new construction and major renovation and all new commercial construction and major renovation and development in any other zone (except residential) on or abutting state highways 37 and 38.
   C.   The provisions of this chapter shall not apply retroactively, and this chapter shall not apply to any building permit issued prior to the effective date hereof. (Ord. 1873, 4-21-1997)
