8-9-5: CONDITIONS OF USE:
   A.   Use Required:
      1.   It shall be unlawful for any person or for the owner or occupant of any premises in the city to discharge or permit to be discharged or cause to be discharged into the public sanitary sewer any stormwater whatever from the roofs of buildings, from the overflow of cisterns, stormwater, surface water, ground water, footing drains, cooling water or unpolluted industrial process waters; and no person shall allow water to run to a sump and then allow said water to be pumped from there to the public sanitary sewer.
      2.   It shall be the legal right of the city to enter any building which is connected therewith to the public sewer to ascertain if the above prohibited acts are being violated, and the city shall have the right to enter said premises or building at all reasonable hours, and it shall be unlawful for any person or persons to resist such entry.
      3.   If the owner or occupant of any such premises shall refuse access to the premises by the city for such purposes, the premises may be disconnected from the public sewer.
   B.   Prohibited Substances:
      1.   General Prohibitions. No residential user shall introduce or cause to be introduced into the public sewer any pollutant or wastewater which causes pass through or interference.
      2.   Specific Prohibitions. No residential user shall introduce or cause to be introduced into the public sewer the following pollutants, substances or wastewater:
         a.   Pollutants which create a fire or explosive hazard in the public sewer, including, but not limited to, wastestreams with a closed cup flashpoint of less than one hundred forty degrees Fahrenheit (140°F) (60°C) using the test methods specified in 40 CFR 261.21;
         b.   Wastewater having a pH less than 5.5 nor more than 10.0, or otherwise causing corrosive structural damage to the public sewer or treatment work equipment;
         c.   Solid or viscous substances in amounts which will cause obstruction of the flow in the public sewer resulting in interference but in no case solids greater than one-half inch (1/2") in any dimension.
         d.   Pollutants, including oxygen demanding pollutants (BOD, etc.), released in a discharge at a flow rate and/or pollutant concentration which, either singly or by interaction with other pollutants, will cause interference with the POTW;
         e.   Wastewater having a temperature greater than one hundred fifty degrees Fahrenheit (150°F) (65°C), or which will inhibit biological activity in the treatment plant resulting in interference, but in no case wastewater which causes the temperature at the introduction into the treatment plant to exceed one hundred four degrees Fahrenheit (104°F) (40°C);
         f.   Petroleum oil, nonbiodegradable cutting oil, or products of mineral oil origin, in amounts that will cause pass through or interference;
         g.   Pollutants which result in the presence of toxic gases, vapors or fumes within the POTW in a quantity that may cause acute worker health and safety problems;
         h.   Trucked or hauled pollutants, except at discharge points designated by the superintendent in accordance with subsection 8-9A-4D of this chapter;
         i.   Noxious or malodorous liquids, gases, solids or other wastewater which, either alone or by interaction with other wastes, are sufficient to create a public nuisance or a hazard to life, or to prevent entry into the sewers for maintenance or repair;
         j.   Wastewater which imparts color which cannot be removed by the treatment process, such as, but not limited to, dye wastes and vegetable tanning solutions, which consequently imparts color to the treatment plant's effluent, thereby violating the city's NPDES permit;
         k.   Wastewater containing any radioactive wastes or isotopes except in compliance with applicable state or federal regulations;
         l.   Stormwater, surface water, ground water, artesian well water, roof runoff, subsurface drainage, swimming pool drainage, condensate, deionized water, noncontact cooling water and unpolluted wastewater, unless specifically authorized by the superintendent;
         m.   Any garbage that has not been properly shredded;
         n.   Quantities of flow, concentrations, or both, which constitute a slug load;
         o.   Wastewater causing, alone or in conjunction with other sources, the treatment plant's effluent to fail a toxicity test;
         p.   Detergents, surface active agents or other substances which may cause excessive foaming in the POTW;
         q.   Fats, oils or greases of animal or vegetable origin in sufficient concentrations to plug, obstruct, or otherwise interfere with the flow of wastewater;
         r.   Wastewater causing a reading on an explosion hazard meter at any point in the POTW of more than fifteen percent (15%) of the lower explosive limit of the meter;
         s.   Any water or waste containing substances which are not amendable to treatment or reduction by the wastewater treatment process employed, or are amendable to treatment only to such a degree that the wastewater treatment plant effluent cannot meet the requirements of its NPDES permit.
Pollutants, substances or wastewater prohibited by this subsection shall not be processed or stored in such a manner that they could be discharged to the POTW.
   C.   Grease, Oil And Sand Traps:
      1.   All traps shall be of a type and capacity approved by the city, and shall be located as to be readily and easily accessible for cleaning and inspection. In the maintaining of these traps the owner(s) shall be responsible for the proper removal and disposal by appropriate means of the captivated material and shall maintain records of dates, and means of disposal, which are subject to review by the superintendent.
      2.   A proper grease trap or catch basin shall be provided for all hotels, restaurants, boarding houses, laundries, garages, butcher shops, lard rendering establishments and all other places where the superintendent may direct.
   D.   Accidental Discharges:
      1.   In the case of any discharge, including, but not limited to, accidental discharges, discharges of a nonroutine, episodic nature, a noncustomary batch discharge, or a slug load, that may cause potential problems for the POTW, the residential user shall immediately notify the superintendent of the incident. This notification shall include the location of the discharge, type of waste, concentration and volume, if known, and corrective actions taken by the residential user.
      2.   Within five (5) days following such discharge, the residential user shall, unless waived by the superintendent, submit a detailed written report describing the cause(s) of the discharge and the measures to be taken by the residential user to prevent similar future occurrences. Such notification shall not relieve the residential user of any expense, loss, damage, or other liability which may be incurred as a result of damage to the POTW, natural resources, or any other damage to persons or property; nor shall such notification relieve the residential user of any fines, civil penalties, or other liability which may be imposed pursuant to this chapter.
   E.   Users Outside City Limits: All residential users of the POTW, including those outside the city limits, are subject to compliance with all provisions contained within this chapter. (Ord. 1759, 12-5-1994)
