8-9-3: PRIVATE WASTEWATER DISPOSAL:
   A.   Where a public sanitary sewer is not available under the provisions of subsection 8-9-2A of this chapter, the sewer service shall be connected to a private wastewater disposal system complying with the provisions of this section.
   B.   Before commencement of construction of a private wastewater disposal system the owners shall first obtain a written permit issued by the superintendent. The application for such permit shall be made on a form furnished by the city, which the applicant shall supplement by any plans, specifications, and other information as are deemed necessary by the superintendent. A permit and inspection fee as provided by title 9, chapter 3 of this code shall be paid to the city at the time the application is filed.
   C.   A permit for private wastewater disposal system shall not become effective until the installation is completed to the satisfaction of the superintendent. The superintendent shall be allowed to inspect the work at any stage of construction, and in any event, the applicant for the permit shall notify the superintendent when the work is ready for final inspection, and before any underground portions are covered. The inspection shall be made within twenty four (24) hours of the receipt of notice by the superintendent.
   D.   The type, capacity, location, and layout of a private wastewater disposal system shall comply with all recommendations of the state department of public health. For persons with a public water supply, no permit shall be issued for any private wastewater disposal system employing subsurface soil absorption facilities where the area of the lot is less than one-half (1/2) acre. For persons with a private well or where the private wastewater system is within five hundred feet (500') of Lake Mitchell, no permit shall be issued for any private wastewater disposal system employing subsurface soil absorption facilities where the area of the lot is less than one acre. No septic tank or cesspool shall be permitted to discharge to any natural outlet.
   E.   No private wastewater disposal system, including drain field, or other subsurface soil absorption facility, shall be located within three hundred fifty feet (350') of the high water mark of Lake Mitchell, Firesteel Creek or the tributary of Lake Mitchell which empties into Kippes Bay; except that a sealed holding tank wastewater system which has been approved by the city may be located no closer than one hundred feet (100') of Lake Mitchell or its watercourse. Sealed portions of a soil absorption facility, including sealed septic tank or drain line from building, may be closer than three hundred fifty feet (350') but not closer than one hundred feet (100') if design is approved by the superintendent.
   F.   At such time as public sewer becomes available to a property served by a private wastewater disposal system, as provided in subsection 8-9-2A of this chapter, a direct connection shall be made to the public sewer within sixty (60) days in compliance with this chapter, and any septic tanks, cesspools, and similar private wastewater disposal facilities shall be cleaned of sludge and filled with suitable material.
   G.   The owner(s) shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times, at no expense to the city.
   H.   No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by the city or the state department of public health. (Ord. 1829, 12-18-1995)
