4-2-8: CLASSIFICATION OF LICENSES:
Liquor licenses shall be divided into classes called class A, class A-1, class B, class C, class C-1, class D, class D-1, class D-3, class E, class E-1, class F, class F-1, class G, class G-1, class H and class I.
   A.   The following classes shall permit the activities described on the premises of the licensee only:
      1.   Class A: A class A license shall permit the licensee to sell alcohol as aforesaid between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight, but such license shall not be granted to any person who permits or furnishes entertainment, excluding jukeboxes, or who serves food, excluding snacks, on the same premises where liquor is sold under such license.
      2.   Class A-1: A class A-1 license shall permit the licensee to sell alcohol as aforesaid between the hours of six o'clock (6:00) A.M. and one o'clock (1:00) A.M. the following morning, but such license shall not be granted to any person who permits or furnishes entertainment, excluding jukeboxes, or who serves food, excluding snacks, on the same premises where alcohol is sold under such license.
      3.   Class B: A class B license shall permit the licensee to sell alcohol at retail as aforesaid between the hours of six o'clock (6:00) A.M. and three o'clock (3:00) A.M. the following morning, every day, but such license shall not be granted to any person who permits regularly planned entertainment on the same premises where alcohol is sold under such license.
      4.   Class C: A class C license shall permit the licensee to sell alcohol at retail as aforesaid between the hours of six o'clock (6:00) A.M. and three o'clock (3:00) A.M. the following morning, every day, but such license shall not be granted to any person who permits entertainment on more than two (2) nights in the same week on the same premises where alcohol is sold under such license.
      5.   Class C-1: A class C-1 license shall permit the licensee to sell alcohol at retail as aforesaid between the hours of six o'clock (6:00) A.M. and three o'clock (3:00) A.M. the following morning, every day, but such license shall not be granted to any person who permits entertainment on the premises at any time other than on Friday, Saturday and Sunday of each week.
      6.   Class D: A class D license shall permit the licensee to sell alcohol as aforesaid between the hours of six o'clock (6:00) A.M. and three o'clock (3:00) A.M. the following morning.
      7.   Class D-1: A class D-1 license shall permit the licensee to sell beer and wine for on premises consumption between the hours of six o'clock (6:00) A.M. and two o'clock (2:00) A.M. the following morning.
      8.   Class D-3: A class D-3 license shall permit the licensee to sell draft wine and draft beer and/or drinks mixed with spirits, as defined in Section 4-2-2 of this chapter, for on premises consumption between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight. A class D-3 licensee may not sell alcohol in its original container and may not sell alcohol for the purpose of being carried out and consumed off the premises of the licensee.
      9.   Class E: A class E license shall be issued only to fraternal or patriotic organizations, organized not for profit, and having charitable purposes. Such licensee shall be given a license to sell liquor as aforesaid between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight; except, that on Fridays and Saturdays, the hours shall be between six o'clock (6:00) A.M. and one o'clock (1:00) A.M. the following day.
      10.   Class E-1: A class E-1 license shall be issued only to municipal and/or governmental corporations. Such licensee shall be given a license to sell alcohol as aforesaid between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight; except, that on Fridays and Saturdays, the hours shall be between six o'clock (6:00) A.M. and one o'clock (1:00) A.M. the following day.
      11.   Class F: A class F license shall permit the licensee to sell "draft wine and draft beer", as defined in section 4-2-2 of this chapter, between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight, every day; except, that on Fridays and Saturdays, said license shall permit the licensee to sell draft wine and draft beer between the hours of six o'clock (6:00) A.M. and one o'clock (1:00) A.M. the following morning. A class F license shall be issued only to restaurants and other establishments of similar nature having, as their primary purpose, the sale of meals or other food products for consumption on the premises. A class F licensee may furnish, as an incidental part of his business, live music or entertainment on the premises. A class F licensee may not sell alcohol in its original container and may not sell alcohol for the purpose of being carried out and consumed off the premises of the licensee.
      12.   Class F-1: A class F-1 license shall permit the licensee to sell draft wine, draft beer and/or "spirits", as defined in section 4-2-2 of this chapter, between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight, every day; except, that on Fridays and Saturdays, said license shall permit the licensee to sell draft wine, draft beer and/or spirits between the hours of six o'clock (6:00) A.M. and one o'clock (1:00) A.M. the following morning. A class F-1 license shall be issued only to restaurants and other establishments of a similar nature having, as their primary purpose, the sale of meals or other food products for consumption on the premises. A class F-1 licensee may furnish, as an incidental part of his business, live music or entertainment on the premises. A class F-1 licensee may not sell alcohol in its original container and may not sell alcohol for the purpose of being carried out and consumed off the premises of the licensee.
      13.   Class G: A class G license shall permit the licensee to sell beer and wine in sealed packages but not for consumption on the licensee's premises, such sales to be made between the hours of six o'clock (6:00) A.M. and one o'clock (1:00) A.M. the following morning. A class G license shall be issued only to retail establishments that have, as their primary purpose, the sale of products other than wine, beer or other alcoholic beverages and which do not furnish entertainment on the premises. All class G licensees shall observe the following regulations: Anyone operating a register in which alcoholic beverages are being sold must be at least twenty one (21) years of age.
      14.   Class G-1: A class G-1 license shall permit the licensee to sell beer, wine, and/or spirits in sealed packages but not for consumption on the licensee's premises, such sales to be made between the hours of six o'clock (6:00) A.M. and one o'clock (1:00) A.M. the following morning. A class G-1 license shall be issued only to retail establishments that have, as their primary purpose, the sale of products other than wine, beer or other alcoholic beverages and which do not furnish entertainment on the premises.
   B.   The following classes shall permit the activities described on premises other than that of the licensee:
      1.   Class H:
         a.   A class H license shall permit the licensee to sell alcohol at retail as a caterer retailer as an incidental part of food service off premises; provided, that the licensee has first obtained a license to sell alcohol at retail on the licensee's premises under one of the classes A through G in subsection A of this section, and the gross sale of food at the catered event is greater than fifty percent (50%) of the total gross sales at the event; provided further, that the sale of alcohol is in bulk to the person or organization conducting the catered event, and no charge is made to persons being served individual drinks; and provided further, that the licensee shall be strictly liable for any ordinance violation related to the catering of alcohol. The class H license shall permit the licensee to sell alcohol as a caterer retailer between the hours of ten o'clock (10:00) A.M. and twelve o'clock (12:00) midnight. Furthermore, the licensee shall file with the village clerk and the chief of police, not less than ten (10) days prior to such function, a description of the location and the hours during which alcohol will be served.
         b.   Nothing herein shall be deemed to authorize the sale of alcohol on a premises or location or at a time which would otherwise be impermissible under this chapter.
      2.   Class I: A class I license shall permit the licensee to sell at retail alcohol at any banquet, picnic, bazaar, fair or similar event between the hours of ten o'clock (10:00) A.M. and twelve o'clock (12:00) midnight. A class I license shall be issued only to organized clubs, societies, associations, fraternal organizations, duly constituted churches or benevolent organizations not for pecuniary profit. A class I license may be issued pursuant to this chapter for one day; two (2) consecutive days; three (3) consecutive days; four (4) consecutive days; five (5) consecutive days; or six (6) consecutive days. The license shall specify on its face the duration. No organization shall be issued more than one class I license during any thirty (30) day period.
   C.   At the closing time applicable to the class of license held by any licensee hereunder, the selling, dispensing and serving of all alcoholic liquor shall cease. The licensee, or agent thereof, shall, from such closing time, have a period of time not to exceed fifteen (15) minutes in which to clear the premises of all persons other than bona fide employees of the licensed establishment who are engaged in cleanup activities. If any law enforcement officer of the village shall believe that any person remaining in any licensed premises after closing time is not a bona fide employee engaged in cleanup activities, said officer may demand evidence documenting said employment. It shall be the responsibility of the licensee, or any agent or employee thereof, to produce proof of bona fide employment. (Ord. 1632, 12-7-2015; amd. Ord. 1775, 10-2-2023)
