4-2-2: DEFINITIONS:
For the purpose of this chapter, the following definitions shall apply:
ALCOHOL, ALCOHOLIC BEVERAGE, ALCOHOLIC LIQUOR, OR LIQUOR: Any beverage capable of being consumed by a human being containing more than one-half of one percent (1/2%) of alcohol by volume including, but not limited to, spirits, wine, or beer.
BEER: A beverage obtained by the alcoholic fermentation of an infusion or concoction of barley, or other grain, malt and hops in water and includes, among other things, beer, ale, stout, lager beer, porter and the like.
CATERER RETAILER: A person who serves alcohol for consumption, either on site or off site, whether the location is licensed or unlicensed, as an incidental part of food service, where prepared meals and alcohol are sold at a package price agreed upon under contract.
COMMISSION: The village board of trustees shall act as the liquor control commission for the village of Milan. The term "commission" shall refer to the village board of trustees.
COMMISSIONER: The village president shall act as the liquor control commissioner for the village of Milan. The term "commissioner" shall refer to the village president.
DRAFT WINE AND DRAFT BEER: Means and includes "wine" and "beer", as defined in this section, which is dispensed in glasses or other open containers suitable for consumption of the same on the premises and is intended by the "licensee", as defined in this section, and by the purchaser thereof to be consumed on the premises of said licensee.
LICENSEE: Any person, firm, partnership, club, association, corporation, or municipal corporation who receives a license under this chapter by original application thereof, transfer, or renewal.
MINOR: A person under the age of twenty one (21) years who is not lawfully employed by the licensee.
PERSON: Includes any individual, firm, partnership, corporation, municipal corporation, club, or any other association of individuals.
SELL AT RETAIL OR SALE AT RETAIL: Has reference to and means sales to a consumer, or to any person for personal use and not for resale.
SPIRITS: Any beverage which contains alcohol obtained by distillation, mixed with water or other substance in solution, and includes brandy, rum, whiskey, gin, or other spirituous liquors, and such liquors when rectified, blended or otherwise mixed with alcohol or other substances.
WINE: Any alcoholic beverage obtained by the fermentation of the natural contents of fruits, or vegetables, containing sugar, including such beverages when fortified by the addition of alcohol or "spirits", as defined in this section, and containing more than 3.8 percent alcohol by weight.
