(a) Definitions. Unless otherwise expressly stated, as used in this section:
(1) "Eligible employee" means an employee, paid on an hourly basis, who is eligible to receive overtime compensation as provided by this section.
(2) "Overtime compensation" means one and one-half times the hourly compensation rate established for eligible employees.
(b) All non-Police Officer hourly employees of the Village shall be entitled to overtime compensation for all hours worked in excess of forty hours per week, provided that said overtime work is properly authorized.
(1) Employees paid on a salary basis are not eligible for overtime.
(3) Authorized vacation days shall be considered as time worked for the purpose of computing non-Police Officer overtime.
(c) All non-Police Officer overtime hours shall have written authorization on an appropriate form. The form shall be signed and approved by the department head, the Village administrator or the Mayor.
(d) Based upon the selection of a 28-day FLSA Section 7(k) Plan, non-salaried Police Officers shall be entitled to overtime compensation for all hours worked in excess of 171 during the selected 28-day period, provided that said overtime work is properly authorized.
(e) The following additional provisions shall apply to non-salaried Police Officer employees:
(1) Non-salaried Police Officers shall be paid a minimum of two hours for a court appearance which the Police Officer is required to make at the request of the Prosecutor or Village Solicitor, if such court appearance is made outside of the Police Officer's normal tour of duty. The Police Officer only shall be compensated at a rate of time and one-half for each hour or fraction thereof based on portal to portal from the Village Municipal Center. No overtime for a court appearance shall be granted during the normal tour of duty.
(2) When a non-salaried Police Officer is in the course of a continuing criminal investigation, during which his or her normal tour of duty has terminated for that particular workday, and if, in the opinion of such Police Officer's immediate supervisor, it is necessary to conduct such investigation without interruption, such Police Officer shall receive overtime compensation for each hour and/or fraction thereof spent in furtherance of such an investigation after his or her normal tour of duty.
(3) In lieu of the above-stated overtime wage payment, the non-salaried Police Officer may elect to receive Compensatory Time for such overtime work pursuant to the provisions of Section 147.04(b). Compensatory time off shall not be considered as time worked for the purpose of computing Police Officer overtime.
(4) Authorized vacation days shall be considered as time worked for the purpose of computing Police Officer overtime.
