147.041 COMPENSATORY TIME FOR HOURLY EMPLOYEES.
   (a)   In lieu of the overtime wage payment provided by Section 147.04(d), eligible non-Police employees may elect to receive Compensatory Time for such overtime work at the rate of one and one-half times the amount of time worked in excess of forty hours during the work week, subject to the following provisions:
      (1)   The scheduling of the use of compensatory time must be approved by the Village Administrator.
      (2)   The maximum amount of compensatory time which may be accrued is forty hours.
      (3)   Any compensatory hours accumulated in excess of forty shall automatically be paid to the employee as wages on the employee’s next pay voucher. The amount of this additional payment shall be calculated by multiplying the employee’s normal hourly rate at the time of such payment by the number of compensatory hours being cashed out.
      (4)   Compensatory time not used by the employee as of the time of termination of employment shall be paid to the employee in the employee’s final pay voucher and/or in a manner consistent with the Village’s customary payroll practices.
      (5)   The Fiscal Officer shall maintain records of all compensatory time and these shall be verified monthly by the Village Administrator.
      (6)   Compensatory time constitutes compensation for overtime by the use of compensated time off; it is not holiday or vacation time and shall not be used in any calculations relating thereto.
   (b)   In lieu of the overtime wage payment provided by Section 147.04(d), eligible employees of the Police Department may elect to receive Compensatory Time for hours worked in excess of 170 during the specified 28-day period. The rate for such compensatory time shall be one and one-half times the amount of time worked in excess of 171 hours during the 28-day period, subject to the following provisions:
      (1)   The scheduling of the use of compensatory time must be approved by the Chief of Police.
      (2)   The maximum amount of compensatory time which may be accrued is forty hours.
      (3)   Any compensatory hours accumulated in excess of forty shall automatically be paid to the employee as wages on the employee’s next pay voucher. The amount of this additional payment shall be calculated by multiplying the employee’s normal hourly rate at the time of such payment by the number of compensatory hours being cashed out.
