(a) Prior to the commencement of grading, excavating or construction work on other than City property, the owner or lessee of the property or the contractor engaged for either grading, excavating or construction work thereon, shall obtain a permit to do so and, as a condition precedent to the issuance of such permit, shall make a deposit of one hundred fifty dollars ($150. 00) for a single-family residential type of use or construction and one thousand dollars ($1,000) for an apartment, commercial or other type. Such a permit shall be obtained from and a deposit made with the Department of Public Service and shall be in addition to the other permits which are required before commencing such work.
(b) If at any one time any depositor constructing single-family homes has on deposit the sum of seven hundred fifty dollars ($750.00) for work being done on any one street, the Director of Public Service, while such amount still remains undepleted by charges including those which have been incurred under the provisions of Section 1335.04, may direct the issuance of further permits for additional proposed work on the same street as provided herein to such depositor without the necessity of further deposits, except in the nature of permit fees. Such a waiver of deposit, however, shall not be made to anyone who has in the past violated any of the provisions of this chapter. The application for the issuance of such permit shall specify the amount of material to be removed from the construction site and the location to which such material is to be transported. In the event that it is determined that such material must be transported over State or Federal highways within the City, the applicant for such permit shall post a cash bond in an amount satisfactory to the City Engineer to guarantee the repair of any damage or destruction to the City's roadways caused as a result of the material transfer. Trucks transporting such excavation fill material upon roads other than those designated as truck routes under Section 440.01 of the Traffic Code should have no more than two axles. (Ord. 1973-61.
