(a) The position of full-time Chief Building Official is hereby established as a nonclassified position, subject to and protected by the provisions of civil service.
(b) The duties of the Chief Building Official shall be directed toward establishing compliance with the construction, building and housing codes of the City and in providing such other services as are requested by the Director of Development.
The code officials or employees charged with the enforcement of the Ohio Building Code, the National Electrical Code, the International Property Maintenance Code and the Unified Fire Code shall not thereby be rendered personally liable and are hereby relieved from all personal liability for any damage occurring to persons or property as a result of any act required or permitted in the discharge of official duties. Any suit instituted against an officer or employee because of an act of or performance by that officer or employee in the lawful discharge of his or her duties and under the provisions of such Codes shall be defended by the legal representative of the jurisdiction until final termination of the proceedings. The code official or any subordinate shall not be liable for costs in any action, suit or proceeding that is instituted pursuant to the provisions of any of such Codes, and any officer or employee acting in good faith and without malice shall be free from liability for acts performed under any provision of such Codes or by reason of any act or omission in the performance of official duties in connection therewith.
