§ 51.21 DISPOSAL OF TREES, TREE LIMBS, STUMPS, BRUSH AND YARD WASTE.
   (A)    No person, firm or entity shall dispose, dump or deposit any tree, bush, tree limb, tree trunk, stump, brush or yard waste upon any property or right-of-way of the city, including the former landfill, except in accordance with rules and regulations set forth herein.
   (B)   Any person, firm or entity desiring to dispose of trees, bushes, tree limbs, stumps, tree trunks, or other yard waste shall first obtain a permit from the City Clerk’s Office and pay the fee set forth below corresponding to the quantity of material to be disposed of at a site designated by the city.
   (C)   A separate disposal permit shall be required for each vehicle and for each disposal. No disposal permit shall be used more than once.
   (D)   Each disposal permit shall be signed by the authorized person for the person, firm, or entity conducting the disposal activity, who shall, in addition to the firm or entity, be individually responsible for compliance with all rules and regulations governing disposal.
   (E)   Each disposal permit shall contain the following information for each person, firm, or entity seeking a disposal permit:
      (1)   Name and name of responsible person if a firm or other entity;
      (2)   Physical address of such person, firm, or entity (no post office boxes);
      (3)   Telephone number at which the person, firm or entity may be reached during daytime hours;
      (4)   Physical address of the location from which the trees, brush, tree limbs, stumps, tree trunks, or other yard waste were removed; and the name and telephone number of the owner of that location;
      (5)   An attached contract, invoice, or paid receipt showing the date, location, and the name of owner of the property, if a commercial tree trimming service or landscape or lawn mowing service was used;
      (6)   Any additional information required by the City Clerk.
   (F)   The rates to be charged for each permit for disposal of trees, bushes, tree limbs, tree trunks, stumps, or other yard waste shall be as follows:
      (1)   Pickup load: $20.
      (2)   Pickup with flatbed trailer: $30.
      (3)   Single-axle truck other than pickup: $30.
      (4)   Double-axle truck: $50.
      (5)   Semi-truck: $100.
   (G)   No person, firm or entity shall dump, deposit, or dispose of any tree, bush, shrub, tree limb, tree trunk, stump, brush or other yard waste that has been removed from any location other than a location within the city limits, and no permit shall be issued on account of any tree, tree limb, tree trunk, stump, brush, bush, shrub or other yard waste that originated from a location outside of the city.
   (H)   (1)   No person, firm or entity shall dump, deposit, or dispose of any tree, bush, shrub, tree limb, tree trunk, stump, brush or other yard waste on city property or a city right-of-way except at a site or sites to be designated by the city, and only on the following days and times:
         (a)   Monday through Friday, between the hours of 8:00 a.m. and 11:00 a.m.; and
         (b)   Monday through Friday, between the hours of 1:00 p.m. and 3:00 p.m.
      (2)   No dumping or disposal shall occur on days when the City Clerk's office is closed.
   (I)   At any site or sites designated by the city for dumping or disposal, no person, firm or entity shall dump anything on any roadway, path, or location other than the specific location designated for disposal.
   (J)   The fee provisions of this section shall not apply to city residents who choose to cut, remove trees, limbs, brush, stumps or yard waste from their own property and dispose of the same at a city-designated site; all other rates and regulations to apply.
   (K)   Any person, firm or entity reasonably believed to have violated any rule or regulation contained herein or any directive provided by the Public Works Director, or her or his designee, shall have their privilege to obtain disposal permits and to sump or dispose, as provided herein, suspended for up to 30 days. The Public Works Director shall provide written notice of such suspension.
   (L)   Any person, firm or entity reasonably believed to have violated any rule or regulation contained herein on two or more occasions shall be permanently barred from dumping or disposing of trees, bushes, shrubs, tree limbs, tree trunks, stumps, brush or other yard waste on any city property or right-of-way. Written notice of debarment shall he issued by the Mayor, Chief of Police or their designee.
   (M)   No person, firm, or entity shall dispose of any tree, bush, tree limb, tree trunk, stump, brush, or other yard waste without first presenting the permit obtained from the City Clerk to personnel at the disposal site, and receiving their approval to deposit the same. In the event no city personnel are present or available, the permit shall be deposited in a box or receptacle provided by the city at the site.
   (N)   Nothing in this section is intended to prevent or prohibit a city resident from depositing trees, limbs, brush, or yard waste cut or trimmed by the resident from his or her own property on the right-of-way adjoining the property for pick up by city personnel.
