1345.09 UNSAFE CONDITIONS.
   When, in the opinion of the Chief Building Official any wall or any part of any building, or building equipment shall be deemed unsafe or unsanitary for the purpose for which such wall or part is used, or which shall constitute a fire hazard or shall be defective, or shall have been erected, constructed, repaired, replaced or removed contrary to the provisions of this Building Code, the Chief Building Official shall notify the owner or his agent, in writing, specifying wherein such unsafe or unsanitary condition exists, or where such building is unsafe, defective or unlawful. If the owner neglects or refuses, after the serving of such notice, to proceed to put such building in a safe condition, or forthwith to pull down or secure such wall or dangerous part or remove any building or part thereof so unlawfully constructed, the owner shall be subject to the penalties provided for violation of this chapter.
   Any structure or building, or any part thereof, which shall be erected, constructed, repaired, replaced, removed or permitted to remain in an unsafe or unsanitary condition, contrary to the provisions of the Building Code, shall be deemed a nuisance, and if the offender, upon ten days notice in writing, shall neglect or fail to remove such building or part thereof, so that the nuisance shall be abated, the offender shall be subject to the penalties provided for violation of this chapter.
