(a) A conditional use permit shall automatically expire upon the occurrence of any of the following:
(1) If the CUP was issued for a use and:
A. The use does not commence within one hundred eight (180) days following the date of issuance of the CUP; or
B. The use, once commenced, is discontinued for a period in excess of ninety (90) consecutive days.
(2) If the CUP was issued for a structure and:
A. Construction is not commenced within one hundred eighty (180) days following the date of issuance of the CUP; or
B. Once constructed, the structure is razed for any reason.
(3) If the CUP was issued pursuant to Section 1162.11 for a buffer, there is a change in the use and/or re-development of the site.
(b) Nothing herein shall prevent the Planning Commission from imposing a specific time limit(s) as a condition of CUP issuance whenever reasonably appropriate given the nature of the proposed use and/or structure.
(c) The provisions of this section shall not preempt any contrary conditions for CUPs issued prior to the effective date of this section.
