1325.03 REOCCUPANCY PERMIT REQUIRED.
   Existing buildings, other than residential dwelling units in which the use or occupancy has been discontinued, shall not be reused or reoccupied by any use or occupant until a reoccupancy permit has been obtained from the Chief Building Official.
   Application for a certificate of occupancy to reoccupy an existing building shall be upon forms provided by the Chief Building Official and shall be accompanied by fees as set forth in Chapter 1305 . Upon receipt of an application and fee, and upon inspection of the existing premises for maintenance of the building in conformance with the building and zoning codes, an occupancy permit may be issued where investigation has determined that there exist no serious hazards, or that the building use or occupancy has not been changed from a prior approved building or zoning use, where such change would require the application of the Ohio Building Code provisions for a change of use or occupancy. Where the owner, occupant, lessee, or sublessee fails to comply with notices to eliminate hazards or comply with the applicable provisions of the building or zoning codes, the appropriate official may initiate legal proceedings for occupancy without an occupancy permit per Section 1129.03 of the Planning and Zoning Code.
