Right-of-way construction permits shall be required prior to the start of any work or the removal or disturbance of any soil in the public right-of-way or in a public easement for the purpose of constructing, connecting, disconnecting, repairing, removing, replacing, or altering
any improvement within the right-of-way, including but not limited to sidewalk, pavement, curb, gutter, water line, storm sewer, electric line, sanitary sewer, gas line, ditch, swale, culvert, drain, driveway apron, cable television line, phone line or any other utility service connection or to significantly alter the direction, volume, or velocity of surface or subsurface stormwater drainage.
Stormwater construction permits shall also be required for the construction, repair, replacement, removal or alteration of any storm drainage improvement in the public right-of- way, in a public easement or on private property when connected to a public stormwater improvement, including but not limited to drains, catch basins, culverts, pipes, "french drains", "trench drains", or other underground or in-ground structures or devices which collect, store, channel, direct or otherwise physically control surface or subsurface water and cause such water to flow into the stormwater system of the City of Mentor.
The City Engineer shall establish policies, procedures, and standards for the submission, review, and issuance of construction permits in a manner compatible with the purposes of this chapter, provided, however, that pavement cuts shall not be permitted without prior approval of the Council of the City of Mentor unless the City Manager determines that there is an emergency condition requiring immediate action.
