There shall be a Board of Zoning and Building Appeals which shall consist of 7 members who shall be electors of the municipality not holding an incompatible public or private office, who shall be appointed by Council for a term of 4 years. Of the 2 additional members of the board to be appointed for the first terms following adoption of this section, 1 shall be appointed for 2 years and 1 shall be appointed for 4 years. The appointments of the 2 additional members shall be made by Council not later than January 5, 1970. A vacancy occurring during the term of any member of the board shall be filled for the unexpired term in the same manner hereby authorized for an original appointment.
The Board of Zoning and Building Appeals shall have the powers conferred upon such boards by the general law of Ohio and shall hear and determine appeals made to it for exceptions to and variations from the application of the provisions of the Zoning and Building Codes of the municipality in harmony with the intent and purposes thereof and from any ordinances, regulations, rules, restrictions, or orders of any administrative official or agency in connection therewith.
Upon approval of this section, decisions of the Board of Zoning and Building Appeals shall be final and binding upon the appellant and the municipality provided, however, the municipality and the appellant shall have the right to appeal the said decision or decisions to a Court of Law.
