(a) No massage establishment shall be operated, established or maintained in the City unless an inspection by the appropriate Building and Fire Inspector results in the issuance of a certificate of occupancy certifying that the establishment complies with the Building and Fire Prevention Codes and each of the following minimum requirements:
(1) Construction or alteration of rooms to be used for a massage establishment requires a separate building permit and rooms used for toilets, tubs, steam baths and showers shall be made waterproof with approved waterproof materials and shall be installed in accordance with the Building Code.
(2) All bathtubs, shower stalls and steam or bath areas and floors shall have surfaces which may be readily disinfected.
(3) Adequate bathing, dressing and locker facilities shall be provided for the patrons to be served at any given time. Separate male and female bathing, dressing, locker and massage room facilities shall be provided in accordance with the requirements of the Building Code.
(4) The premises shall be kept clean and shall have adequate equipment for disinfecting and sterilizing nondisposable instruments and materials used in administering massages. Such nondisposable instruments and materials shall be disinfected after use on each patron.
(5) Closed cabinets shall be provided and used for the storage of clean linen, towels, and other materials used in connection with administering massages. All soiled linens, towels and other materials shall be kept in properly covered containers or cabinets, which containers or cabinets shall be kept separate from the clean storage areas.
(6) Toilet facilities shall be provided in accordance with the requirements of the Building Code.
(7) Lavatories or washbasins provided with both hot and cold running water shall be installed in either the toilet room or a vestibule immediately adjacent thereto. Lavatories or washbasins shall be provided with soap and a dispenser and with sanitary towels.
(8) The premises shall be equipped with a service sink for custodial services in accordance with the requirements of the Building Code.
(9) The premises shall meet the requirements of the Building Code and fire prevention regulations.
(10) Massage establishments in a residential building shall be subject to a home occupation permit and a conditional use permit and shall maintain a separate entrance which shall not open off the living quarters, and which shall not have any door or openings leading to the living entrance through garages or any other rooms. Massage establishments are prohibited in the basement of a residence. Individual(s) is/are prohibited from residing in a massage establishment unless the facility is a residential building and otherwise in compliance with this chapter. Upon application, a representative of the City shall provide to the applicant a copy of this chapter and all the necessary information and forms concerning massage establishments and shall obtain a signed acknowledgment from the applicant acknowledging receipt thereof.
(b) Upon completion of work for which a building permit had been issued and upon inspection, the Building Officia1 shall provide a certificate of occupancy to certify that the proposed massage establishment complies with all the requirements of this section and shall send a copy of such certification to the Director of Planning.
