The Director of Planning shall issue a permit to maintain, operate, or conduct a massage establishment subject to the following conditions.
The applicant shall present a copy of the certificate of occupancy or reoccupancy issued for a completed building permit or reoccupancy application, signed by the appropriate Building official indicating that the building meets the requirements of the Building Code and the fire prevention regulations, respectively.
The applicant shall present a copy of a certificate from the Chief of Police indicating that the applicant or applicants and any other person who will be directly or indirectly engaged in the management or operation of a massage establishment have not been convicted in a court of competent jurisdiction of a felony; an offense involving sexual misconduct with children; prostitution; soliciting for purposes of prostitution; promoting prostitution, compelling prostitution, procuring, pandering; keeping a place of prostitution; soliciting; any crime involving dishonesty, fraud or deceit; or any other criminal offense opposed to decency and morality; within the last five years.
Every massage establishment permit issued pursuant to this chapter will terminate on December 31 following the date of issuance, unless sooner suspended or revoked and shall be renewed annually in December before the first day of January of the next year. No massage establishment shall be required to discontinue business because of the failure of the City to act on a renewal application filed in a timely manner and pending before the City on the expiration date of the establishment's permit.
