Ordinances and resolutions shall be introduced in the Council only in written or printed form, and the adoption, rejection, or amendment, time of taking effect, and the signing thereof shall be in the manner provided by the Constitution and laws of the State of Ohio as the same applies to villages (sic.) except as otherwise in this Charter provided.
A. The following legislation shall not become effective until it is approved by a majority of the electors of the City of Mentor voting thereon at the next general or primary election occurring not less than sixty (60) days after passage of such legislation:
1. Legislation providing for a zoning change of lands from any residential district zoning classification to an industrial or commercial district zoning classification.
2. Legislation providing for a zoning change of lands to a multi-family residential district zoning classification.
3.. Legislation providing for a zoning change of lands to a single family residence district zoning classification which permits lots of less than 15,000 square feet. (Amended 2-l-77).
4. Legislation providing for a zoning change of lands from any industrial district zoning classification to a commercial district zoning classification. (Amended 11-2-93)
5. Legislation providing for a zoning change of lands from the Conservation District Zoning Classification (C-1) or the Commercial Recreation District Zoning Classification (C-2) to any other zoning district classification. (Amended 11-5-96)
6. Legislation authorizing any of the following activities related to the Mentor Marina shall require voter approval:
a. The sale or lease of the Marina;
b. Any residential or industrial development; and
c. Any commercial development inconsistent with a marina.
The Mentor Marina consists of approximately 180 acres and includes all of permanent parcel numbers: 16-D-096-0-00-001-0, 16-D-096-0-00-004-0,16-D-099-0-00-008-0, 16-D-099-0-00-011-0, 16-D-099-0-00-012-0, and 16-D-096-0-00-002-0.
7. Legislation authorizing any of the following activities related to the Mentor Lagoons Nature Preserve shall require voter approval:
a. The sale or lease of the Nature Preserve;
b. Any development; and
c. Any activities inconsistent with the conservation of land, Nature Preserve activities, and the protection of ecologically sensitive areas and other areas with unique features.
The Mentor Lagoons Nature Preserve consists of approximately 280 acres and includes all of the land owned by the City of Mentor north of the Mentor Marina and extending to the Lake Erie shoreline, thence east to and including permanent parcel number 16-D-104-0-00-001-0. (Amended 11-4-97; 11-3-20.)
B. Division A shall not apply to legislation approving a rezoning of commercial or industrially zoned land which (i) is economically distressed as defined by the Mentor Code of Ordinances, and (ii) that will be redeveloped as part of the approved rezoning for a mixed-use development.
