521.12 GARAGE OR YARD SALES.
   No person shall conduct a "garage sale" or "yard sale" which, as used in this chapter, means any sale of household goods, furniture, furnishings, equipment, utensils, appliances, clothing or other personal property from, in, about or upon any premises, property or residence zoned for or utilized for residential purposes within this City to which the public is invited or allowed to attend; including such sales commonly termed "basement sales", "house sales", "lawn sales" or "estate sales" without strict adherence to the following requirements:
   (a)    There shall be no more than three sales at the same premises, property or residence in any calendar year and no sale shall commence within twenty-eight days of the end of a prior garage or yard sale at the same location. No garage or yard sale shall extend for more than four consecutive days.
   (b)   No person shall post a sign advertising a garage or yard sale within the public right of way, on a utility pole, traffic or street sign or upon other public property.
   (c)    No person conducting a garage sale or yard sale shall fail to provide sufficient parking nor shall such person fail to ensure adequate traffic supervision to prevent traffic congestion at the time and place of the sale.
   (d)    No person shall conduct a garage or yard sale before 9:00 a.m. on any day or after 7:00p.m. on any day.
   (e)   Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor for a first offense and shall be fined not more than one hundred and fifty dollars ($150.00) or ordered to complete thirty (30) hours of community service. For any subsequent offense, such person is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both.
