(a) For the purpose of reducing air pollution to protect the rights of nonsmokers to breathe clean air and to abate a public nuisance, smoking in all public places owned by, leased by or otherwise controlled by the City of Mentor is prohibited except in areas designated by posted signs as permitted smoking areas.
(b) As used in this section:
"Smoking" means inhaling, exhaling, burning, or carrying any lighted or heated tobacco product or plant product intended for inhalation in any manner or in any form. "Smoking" includes the use of an electronic smoking device and a vapor product.
"Public place" means that portion of (i) any enclosed indoor area owned by, leased by or otherwise controlled by the City of Mentor and used as a meeting place for the general public or in which members of the general public are permitted free access and (ii) any outdoor area owned by, leased by or otherwise controlled by the City of Mentor and used as an area hosting meetings, performances, special events, or such other similar uses for the general public.
(c) Whoever violates this section is guilty of a minor misdemeanor.
