907.09 SEVERABILITY.
   Should any part or provision of this chapter be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the chapter as a whole or any part thereof other than the part held to be invalid.

907.10 APPEALS.
   (a)   A person aggrieved by the administration of this chapter may have thirty (30) days to appeal by petitioning the City Forester in writing. The City Forester will have ten (10) days to consult with and make recommendations to the Service Director and the Shade Tree Commission, who shall issue a decision in ten (10) days thereafter.
 
   (b)   No action can be taken with regard to the permit, contract, or notice in question, until the appeal process is completed. (Ord. 50-04. Passed 4-12-04.)
907.99 PENALTY.
   Any person who violates, neglects, or refuses to comply with or assists in the violation of any provisions of this Chapter, or any order, permit, or notice issued pursuant thereto, shall be fined not more than one hundred dollars ($100.00) for each such violation. Each day any such violation continues shall constitute a separate offense, and each tree removed or damaged shall also constitute a separate offense. Additionally, any person who harms, damages, or removes a public or protected tree will be charged according to the cost replacement formula set forth in Section 907.08(d). (Ord. 50-04.
