3-4-1: DEFINITION:
For the purpose of this chapter, "residential sale" means any sale of what is held out to be or is commonly known as a garage, porch, room, backyard, or patio sale or any other type of general sale conducted from or on any premises not located in a zoning district which permits such sales, where goods or articles of any type are held out for sale to the public. This definition shall not include a situation where specific items are held out for sale and all advertisement of such sale specifically names the items to be sold. (1987 Code § 9-301)
3-4-2: LICENSE REQUIRED PER LOCATION; RESTRICTIONS:
   A.   License Required: No person shall hold, conduct, engage in, or participate in any manner in, a residential sale without a license as provided for in this chapter.
   B.   Compliance With Regulations: The issuance of a license under the provisions of this chapter shall not exempt such persons from the terms and provisions of other ordinances.
   C.   Separate Licenses; Time Limit; Nonprofit Organizations: A separate license shall be required for each location at which a residential sale is to be held. No location shall be eligible for more than one license in any sixty (60) day period, unless there has been a change in the ownership of such location, or unless licenses for such locations have been issued to nonprofit organizations, associations, or corporations. No nonprofit organization, association or corporation may be issued more than one such license in any sixty (60) day period. (1987 Code § 9-302)
