709.04 LICENSE FEES.
   Fees for licenses to sell Christmas trees issued pursuant to this chapter are as follows:
   (a)   Persons established in the City in the business of nursery and tree selling on a year-round basis at a fixed location, one dollar ($1.00); and
   (b)   Persons in any permanent business other than designated in subsection (a) hereof, and itinerant persons or merchants at locations in the City which are temporary, five hundred dollars ($500.00).

709.05 LOCATION; SALES FROM VEHICLES.
   No person shall conduct the business of Christmas tree selling in any zoning district in the City other than U-4 and U-4A Districts, except that churches, religious organizations associated or connected with a church, and bona fide charitable service organizations may conduct such a business in any zoning district in the City.
   No person shall sell or offer for sale Christmas trees from a truck or other vehicle driven from house to house.
709.06 NO-FEE LICENSE FOR RELIGIOUS AND CHARITABLE ORGANIZATIONS.
   A no-fee license for the sale of Christmas trees in the City shall be required of a church or religious organization associated or connected with a church or a bona fide charitable service organization. Nothing in this section shall exempt a church or religious organization associated or connected with a church or a bona fide charitable service organization from making the deposit required by Section 709.03.

709.07 PLOT OF VENDING AREA.
   The application for a license to sell Christmas trees shall be accompanied by a plot of the property to be used. Included on the plot shall be the location and number of off-street parking spaces, the location of the display area for trees, the location of temporary lighting, if any, the location of roadways for entrance to and exit from the lot, the location of any storage area for trees, and the location of any existing structures or roadways. The failure of the vendor of Christmas trees to comply with the original plot of the property shall constitute a violation of this chapter.
709.08 SETBACK REQUIREMENTS; POLICING; LIGHTING PERMIT; FIRE PREVENTION.
   No person shall conduct the business of Christmas tree selling in violation of the Zoning Code in regard to front, side and rear setbacks. Each vendor engaged in the business of Christmas tree selling shall comply with the orders of the Chief of Police to provide adequate policing. The installation of temporary lighting shall only be permitted after a permit for temporary lighting has been secured from the Director of Buildings. Each vendor engaged in the business of Christmas tree selling shall comply with the orders of the Fire Prevention Bureau. Changes in the physical layout of the plot of the property ordered by the Bureau or the Chief shall exempt the vendor from a violation of Section 709.07.

709.09 REMOVAL OF UNSOLD TREES; BURNING PROHIBITED.
   No vendor of Christmas trees or his or her agent or employee shall dispose of unsold Christmas trees by burning them on the property used for the sale of Christmas trees. All merchandise, property, refuse and Christmas trees remaining upon the termination of business shall be physically removed from the property in a closed vehicle so as not to litter public streets or roadways.
709.99 PENALTY.
   Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
