(a) Sewer tap-in charges are to be paid pursuant to § 942.04(a). However, Council may grant an extension of time for payment in the following cases upon application by the property owner or agent thereof:
(1) Unemployment;
(2) Catastrophic accident;
(3) Poverty and near poverty level income; and/or
(4) Any similar circumstance that in the judgment of Council constitutes a hardship warranting an extension of time for payment.
(b) Prior to consideration of the grant of any extension of time, the property owner or agent thereof, shall file an application to Council on a form provided for that purpose, which application shall be accompanied by the following:
(1) A detailed statement of current conditions explaining the need for an extension of time. The statement shall include a description of the circumstances creating the need; and
(2) Verification of the owner’s income in one of the following forms:
A. If the owner receives Social Security Income, a Social Security report showing the amount received in the last 12 months;
B. If the owner receives welfare, a welfare report showing the amount received in the last twelve months; or
C. If the owner is otherwise employed, an accurate statement of the owner’s income of the last 12 months, signed by the owner and a copy of the last federal tax return filed by the owner.
(c) Council may, in its sole discretion, consider all of the circumstances surrounding the application and reasons therefor and determine a time frame for payment.
(d) If an extension is granted and the person receiving the extension subsequently defaults on an extended payment plan, the owner’s account will be subject to disconnection procedures as provided in § 942.10.
