No Non-Owner Occupied Residential Property, as defined in Section 6-1-85 of this Code, shall be used or occupied after any change occurs in the existing occupancy of said building or structure, or portion thereof, until the Building Official has issued a certificate of occupancy as provided herein. A change in the existing occupancy of a building or structure shall be said to occur when: (a) all individuals residing within said building or structure, or portion thereof, move out of or no longer reside within said building or structure, or any other portion thereof, or (b) when any individual, not previously residing within said building or structure, or any portion thereof, moves into or begins to reside within said building or structure, or any other portion thereof. Part (b) of the previous sentence does not apply if any individual that is moving into said building or structure is the parent, sibling, or child of the owner of said building or structure.
No Owner Occupied Residential Property, as defined in Section 6-1-85(A) of this Code, shall be used or occupied after completion of construction on said building or structure, or portion thereof, until the Building Official has issued a certificate of occupancy as provided herein.
