10-14-3: PROHIBITED/PERMITTED LOCATIONS:
   A.   Intermodal Shipping Containers shall not be placed, maintained, stored, or used in any residentially zoned district within the corporate limits of the City of Marion unless otherwise noted below. Commercial uses are permitted under the following zoning districts and uses:
      1.   Industrial Use: Subject to compliance with the regulations and standards set forth in section 10-14-4 of this chapter, Intermodal Shipping Containers may be placed, maintained, stored, or used on property with a zoning classification of I district (industrial).
      2.   Temporary Construction Use: Subject to compliance with the regulations and standards set forth in section 10-14-4 of this chapter, contractors may place, maintain, store, or use Intermodal Shipping Containers on property located within any zoning district within the city during the period of construction, repairs, or remodeling of the exterior or interior of premises located at the construction site. Each such Intermodal Shipping Container shall be removed from such property within ten (10) consecutive calendar days after the completion of such construction activity; provided however, if construction ceases for a period of sixty (60) consecutive calendar days or is otherwise abandoned, such Intermodal Shipping Container shall be removed no later than ten (10) consecutive calendar days after the city's Building and Code enforcement officer issues a notice and order to remove such Intermodal Shipping Container.
      3.   Seasonal Use: Subject to compliance with the regulations and standards of section 10-14-4 of this chapter, Intermodal Shipping Containers may be placed, maintained, stored or used during a Seasonal Business Use period on private property located in a C-1 district (commercial) or C-2 district (commercial) zoning classification for the purpose of displaying for retail sale to the general public flowers, plants, shrubbery, or landscaping merchandise, goods, materials, or other products that are permitted to be sold in the City of Marion.
      4.   Storage Use: Subject to compliance with the regulations and standards of section 10-14-4 of this chapter, and only permitted in C-1 or C-2 zoning districts, Intermodal Shipping Containers may be used to store excess goods or merchandise for sale that are consistent with the goods or merchandise that are typically sold or offered at the permitted location.
      5.   Commercial Occupancy: Commercial occupancy may be permitted as per Title 10 of this code. Permits shall only be issued in zoning districts C-1 or C-2. All modifications made for commercial occupation must conform to Section 3115 of the 2021 International Building Code standards. A building permit consistent with Title 10-1-2 of this code will be required for any modifications made to an Intermodal Shipping Container for such use. For the purposes of such occupancy, section 10-1-9 of this code shall not apply.
         a.   Any Commercial Occupancy permit allowed under this exception for an Intermodal Shipping Container that will be used for the sale of any food product, for consumption on-site or off-site, shall at all times be in compliance with Franklin-Williamson Bi-County Health Department Rules and Regulations.
         b.   An exception may be made for intermodal shipping containers with minimal modifications made that is used for office space only that otherwise complies with 10-14-4. (Ord. 3549, 8-12-2019; amd. Ord. 3790, 3-28-2022)
