10-14-4: REGULATIONS AND STANDARDS:
   A.   An Intermodal Shipping Container shall be placed and maintained to meet all minimum front, side, and rear yard or lot setback requirements for the applicable zoning district.
   B.   No Intermodal Shipping Container shall have dimensions greater than forty feet six inches (40'6") in length, eight feet six inches (8'6") in width, and ten feet (10') in height.
   C.   No signage other than on-premises advertisements and owner signage shall be attached or allowed on any Intermodal Shipping Container.
   D.   All Intermodal Shipping Containers shall be reasonably maintained in a condition free from excessive visible deterioration. The owner of the Intermodal Shipping Container shall be responsible for its maintenance.
   E.   Intermodal Shipping Containers shall not be placed or maintained or stored or used on property or within any area that is within the floodplain or floodway or within any designated landscape or flood retention or detention areas.
   F.   Intermodal Shipping Containers shall be located to the rear of any business or commercial or industrial property, unless permitted to be used for commercial occupancy or as an advertisement of Intermodal Shipping Containers for sale or rent, as may be permitted by this section.
   G.   Intermodal Shipping Containers shall not contain any personal property, materials or liquids of a toxic, hazardous, flammable, or radioactive nature.
   H.   Intermodal Shipping Containers placed, maintained, stored, or used must be kept safe, structurally sound, stable, and in good repair. Any Intermodal Shipping Container that becomes unsound, unstable or otherwise dangerous shall be immediately repaired or safely removed from the property where located by the owner or occupant thereof.
   I.   Intermodal Shipping Containers shall not be placed, maintained, stored, or used in a manner that impedes the flow of traffic or access to any public street, roadway, alleyway, right of way, public parking area, public utility or drainage easements, adjacent structures or buildings, or fire hydrants, or access by fire, rescue, police, and emergency vehicles.
   J.   Unless permitted under 10-14-3A5 an Intermodal Shipping Container shall not be modified, retrofitted, or used for on-site human habitation or for retail sale to the public of any food products, nor shall it have windows, heating and cooling, plumbing, air circulation systems, interior lighting, or multiple entrances.
   K.   Intermodal Shipping Containers shall be safely secured, and all enclosures locked when not in immediate use. (Ord. 3549, 8-12-2019; amd. Ord. 3790, 3-28-2022)
