A. Permit Required; Enforcement And Penalties:
1. Permit Required:
a. No person nor business entity shall erect, build or construct or install any building, edifice or structure for residential, commercial, recreational or storage use within the corporate limits of the City unless a permit from the Code Enforcement Officer for such erection, building, construction or installation has been applied for, approved and issued.
b. No City water or sewer service shall be connected to new construction of any structure, building or edifice unless a permit to erect, build, construct or install such structure, building or edifice, as required by subsection A1a of this section has been issued and a copy thereof filed with the Office Manager of the Water Department.
c. (1) No commercial building permit authorizing the construction of any structure shall be issued until:
(A) The Chief of the Fire Department has certified the applicant for a building permit, has complied with the provisions of subsection 9-2-4E of this Code; and
(B) The Superintendent of the Water Department has certified the applicant for a building permit, has received a water connection permit and paid the fees required therefor.
(C) The Superintendent of the Water Department has certified the applicant for a building permit, has received a sewer connection permit and paid the fees required therefor.
(2) No business, individual or other entity shall connect to the City water system in any way without first obtaining a permit from the Superintendent of the Water Department.
2. Enforcement And Penalties:
a. Citation: The Code Enforcement Officer is authorized to issue a citation against any person or business entity that is in violation of this subsection. Such citation shall be filed in the County Circuit Court for processing.
b. Injunction: The Code Enforcement Officer is authorized to petition the County Circuit Court for a writ of injunction prohibiting any person or business entity from proceeding with construction, erection or installation of any building, edifice or structure for residential, commercial, recreational or storage use unless a permit for such activity has been applied for, approved and issued.
c. Penalties:
(1) For a violation of subsection A1a of this section, a person or business entity may be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00).
(2) For a second or subsequent violation of subsection A1a of this section, a person or business entity may be fined not less than two hundred dollars ($200.00) nor more than one thousand dollars ($1,000.00).
B. Permit Fees: Building permit fees are as follows:
1. Residential:
a. Single- and multi-family structures:
$0.15 per square foot
$100.00 minimum fee
b. Accessory buildings:
$0.15 per square foot
$15.00 minimum fee
2. Commercial and industrial progressive rates:
Up to 50,000 square feet | $0.15 per square foot |
50,001 to 200,000 square feet | 0.12 per square foot |
200,001 square feet and over | 0.10 per square foot |
