1242.05 BONDS REQUIRED.
   (a)   Prior to acceptance by Council of a plat and the areas reserved for public purposes therein for record purposes only, as approved by the Planning Commission and Council, the persons making such allotment or subdivision shall post with the Clerk of Council a surety bond in form satisfactory to the Director of Law, or as otherwise provided herein, in an amount equal to the cost of construction of all public improvements, as estimated by the City Engineer. Thereafter, following construction and approval of the construction of underground public improvements by the City Engineer, building permits may be issued for the construction of buildings abutting the roadways or benefited by the improvements. A maintenance bond or bonds for the improvements to be installed shall also be given as provided in Section 1446.01(b). The foregoing procedure shall be followed for the giving of bonds when work performed by developers is in public property or is to become public work or property in other than public streets. (See Section 1446.01(b) for release of bonds. See Section 1242.10 re street improvements.)
   (b)   A bond shall be posted for the construction of all improvements required to complete necessary public facilities as set forth in the relevant provisions of Chapters 1020, 1024, 1040 and 1044 of the Streets, Utilities and Public Services Code, and Chapter 1468 of the Building and Housing Code, and shall also be required for the repair of existing facilities in dedicated streets, particularly those which had been improved many years before. In the case of repair of existing facilities in dedicated streets, when underground improvements are completed and approved by the City Engineer, and when a bond is posted, permits may be issued. Such bond shall be in the form provided in Section 1446.01(a). (See also Section 1262.03(b).)
   The developer's bond form (Section 1446.01(a)(2)) may be used for the construction of improvements. The procedure for the approval and acceptance of such improvements shall be as set forth in Section 1242.06.
