If the owner of a building, or structure, fails to comply with an order issued pursuant to G.S. § 160A-429 from which no appeal has been taken, or fails to comply with an order of the Town Council following an appeal, he or she shall be guilty of a Class 1 misdemeanor, additionally subject the offender to civil penalty to be recover by the town pursuant article G.S. § 14-4; every day such person shall willfully fail, or refuse, to comply with any final order, or direction, of the Code Official or Town Council made by virtue, and in pursuance of this article, shall constitute a separate, and distinct, offense.
