§ 91.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   (1)   Any person or entity who violates or fails to comply with any provision of § 91.01 shall, upon conviction, be subject to a fine of not less than $100 nor more than $500. Each day during which a violation exists or continues shall be deemed a separate offense.
      (2)   The Village Administrator may determine and administratively assess a fine for any improper backfill or failure to notify which he or she may find, noting that the fine shall continue for each day that the violation continues. The per diem improper backfill or failure to notify fine shall be $75 per day. If the offender pays the administrative fine assessed and also terminates and corrects the improper trench backfill, then no further proceedings shall be required.
      (3)   The Village Administrator may also, in the event he or she finds any improper backfill, issue a stop work order which shall require the immediate cessation of any further work on the project accessed by or served by the improper backfill, until the violations are remedied.
   (C)   Any person convicted of a violation of § 91.02 shall be fined in a sum of not less than $50 nor more than $500.
   (D)   Any person violating any of the provisions of § 91.15 shall be fined not less than $1 nor more than $500 for each offense; and a separate offense shall be deemed committed on each day during or on which the violation continues.
