PLANNING COMMISSION
§ 31.25 QUALIFICATIONS OF PLANNING COMMISSION MEMBERS.
   (A)   The Planning Commission shall consist of the number of members as determined and appointed by the Madison Lake City Council from among residents of Madison Lake.
   (B)   Terms of office for members shall be for 3 years. The City Council may appoint an ex officio member to serve as liaison with the Planning Commission to the City Council. If this appointment is made from members of the City Council, the term of office shall terminate with the office from which ex officio is derived.
   (C)   Members other than ex officio shall be appointed from among persons in a position to represent the general public interest, and no person shall be appointed with private or personal interest likely to conflict with the general public interest. If any person appointed shall find that private or personal interests are involved in any matter coming before the Commission, that person shall disqualify himself or herself from taking part in any action on this matter, or be disqualified by the Chairperson of the Commission.

§ 31.26 REMOVAL FROM OFFICE; VACANCIES.
   Any member of the Commission may be removed from office for just cause and on written charges by a 4/5 vote of the City Council, but the member shall be entitled to a public hearing before the vote is taken. In addition, any member may be removed for non-attendance at Planning Commission meetings without action by the City Council according to the rules adopted by the Planning Commission. It shall be the duty of the Chairperson of the Commission to notify the City Council promptly of any vacancies occurring in membership, and the City Council shall fill the vacancies within 60 days for the unexpired term of the original appointment.

§ 31.27 OFFICERS, RULES, EMPLOYEES, SALARIES, AND EXPENSES.
   (A)   The Commission shall elect a Chairperson and Vice Chairperson from among those of its members who are not appointed ex officio, and may create the other offices as it may determine. All members, including ex officio members, shall be entitled to vote. Terms of all elected offices shall be for 1 year, with eligibility for re-election.
   (B)   The Commission shall adopt rules for its governance and for the transaction of its business, and shall keep a record of attendance at its meetings and of resolutions, transactions, findings, and determinations showing the vote of each member of each question requiring a vote, or if absent or abstaining from voting indicating the fact. The records of the Commission shall be public record.
   (C)   Subject to approval of the City Council and within limits set by appropriations or other funds made available, the Commission may employ the staff, technicians, and experts as may be deemed proper, and may incur the other expenses as may be necessary and proper for the conduct of its affairs.
   (D)   Members of the Commission shall receive the sum of $25 for each duly called meeting of the Planning Commission they attend.

§ 31.28 APPROPRIATIONS, FEES, AND OTHER INCOME.
   The City Council shall make available to the Commission the appropriations as it may see fit for compensation, fees, and expenses necessary in the conduct of its work. The Commission shall have the authority to expend all sums so appropriated and other sums made available for its use from grants, gifts, and other sources for the purposes and activities authorized by this subchapter.

§ 31.29 FUNCTIONS, POWERS, AND DUTIES.
   (A)   The functions, powers, and duties of the Planning Commission shall be in general:
      (1)   To acquire and maintain in current form the basic information and background data as is necessary to an understanding of past trends, present conditions, and forces at work to cause changes in these conditions;
      (2)   To prepare and keep current a comprehensive general plan for meeting present requirements and the future needs as may be foreseen;
      (3)   To establish principles and policies for guiding action affecting development in the City of Madison Lake and its environs;
      (4)   To prepare and recommend to the City Council ordinances, regulations, and other proposals promoting orderly development along lines indicated as desirable by the comprehensive plan;
      (5)   To determine whether specific proposed developments conform to the principles and requirements for the comprehensive plan and the ordinances;
      (6)   To keep the City Council and the general public informed and advised as to all planning and development matters;
      (7)   To conduct the public hearings as may be required to gather information necessary for the drafting, establishment, and maintenance of the comprehensive plan and ordinances and regulations related to it, and to establish public committees for the purpose of collecting and compiling information necessary for the plan, or for the purpose of promoting the accomplishment of the plan in whole or part; and
      (8)   To perform other duties which may be lawfully assigned to it, or which may have bearing on the preparation or accomplishment of the plan.
   (B)   In connection with its duties, and within the limit of list funds, the Commission may make, cause to be made, or obtain maps, aerial photographs and surveys, and special studies on the location, condition, and adequacy of specific facilities of the city and, as appropriate, its environs, including, but not limited to:
      (1)   Studies on housing;
      (2)   Commercial and industrial facilities;
      (3)   Economic development;
      (4)   Parks and trails;
      (5)   Playgrounds and other recreational facilities;
      (6)   Schools;
      (7)   Public and private utilities; and
      (8)   Traffic, transportation, and parking.
   (C)   All city employees shall, upon request, and within a reasonable time, furnish to the Commission or its employees or agents such available records or information as may be required in its work. The Commission, or its employees or agents, may in the performance of official duties enter upon lands and make examinations or surveys in the same manner as other authorized city agents or employees, and shall have the other powers as are required for the performance of official functions in carrying out the purposes of this subchapter.
