§ 91.23 ISSUANCE OF CITATIONS.
   (A)   In addition to, or in lieu of impounding a dog or cat found at large (not in restraint), any animal control officer, police officer, or law enforcement officer, so authorized, may issue to the owner of a dog or cat a citation specifying the section or sections of this subchapter violated and indicating the specific nature of the violation. Such citation shall impose upon the owner of the dog or cat an obligation of appearance in the Jefferson County Court to answer the charges in the citation at the time and place indicated in the citation.
   (B)   Any animal control officer, police officer, and law enforcement officer in Jefferson County or any city or town therein is expressly authorized to write and issue such citations.
   (C)   If at a proceeding to enforce the sections of this subchapter the Court finds that the person:
      (1)   Has violated a section of this subchapter; and
      (2)   Has taken steps to and is no longer in violation of this subchapter; and
      (3)   Has no previous judgments of violation of this subchapter against them, the person is not liable for any cost of monetary judgment, notwithstanding IC 34-28-5-1 through 34-28-5-14.

OPERATION OF ANIMAL SHELTER
§ 91.40 PURPOSE OF AGREEMENT.
   The purpose of this interlocal agreement shall be to provide the orderly operation of the animal shelter and to advise both the county and this city on matters pertaining thereto. This agreement shall last until December 31, 1995, unless sooner terminated as set forth in § 91.42.

§ 91.41 MADISON-JEFFERSON COUNTY ANIMAL SHELTER ADVISORY BOARD.
   (A)   A separate legal entity shall be established called the Madison-Jefferson County Animal Shelter Advisory Board with five members appointed as follows:
      (1)   One member shall be appointed by the County Board of Commissioners;
      (2)    One member shall be appointed by the Mayor of this city;
      (3)   One member shall be appointed by the County Council;
      (4)   One member shall be appointed by the Common Council of this city; and
      (5)   One member shall be the County Health Officer.
   (B)   At the first meeting, the Board members shall determine by lot the terms of the respective members, with one member serving for one year, one member serving for two years, two members serving for three years, and two members serving for four years. Thereafter, each member will be appointed for four years or until the agreement expires or is terminated, whichever comes first.
   (C)   Any terminations, vacancies, or replacements that need to be appointed or reappointed prior to or at the expiration of a term as set forth in divisions (A) and (B) above shall be made by the entity or person appointing that Advisory Board member pursuant to divisions (A)(l) through (4).
   (D)   The Board so established shall have the power to establish animal shelter rules and regulations pursuant to and consistent with ordinances established by the county and this city. The County Animal Shelter Advisory Board shall be advisory to this city and the county. The Board shall prepare an annual report and present this report to the Common Council of this city and the County Commissioners.

§ 91.42 TERMINATION OF AGREEMENT.
   This agreement may be terminated by either the city or the county by either party giving notice to the other party three months prior to the proposed termination date thereof.
