909.99 PENALTY.
   (a)    Whoever violates Section 909.01 of this chapter is guilty of a minor misdemeanor. A separate violation of Section 909.01 shall occur each day after notice has been served to remove the tree.
   (b)    If upon inspection of any property described in Sections 909.02 or 909.03 by any police officer or other public official authorized to make such inspections by Council, it is determined that any property owner or occupant is violating Section 909.02 or 909.03, the Clerk shall give thirty days written notice to such property owner to cut and remove tree limbs overhanging the sidewalk or street, or remove dead or diseased trees. In the event that the owner of the real property cannot be located or determined, such notice shall be published in a newspaper of general circulation in the community for one week. Whoever fails to cut or remove such overhanging tree limbs, dead trees, or weeds after such notice shall be guilty of a minor misdemeanor. A separate violation shall occur each day after thirty days notice from the date of service or publication of the notice referred to above.
   (c)    Whoever fails to comply with the notice provided for in Section 909.04 after two weeks from the date such notice is served or published is guilty of a second degree misdemeanor. (Ord. 61-1988. Passed 6-9-88.)
