8.30.330   Reporting requirements.
   A.   An accident report is required for each leak or spill in a facility subject to this chapter in which there is a release ofliquid resulting in any of the following:
      1.   Explosion or fire not intentionally set by the operator;
      2.   Release of five gallons or more of liquid, except that no report is required for a release of less than five barrels resulting from a maintenance activity if the release is:
         a.   Not otherwise reportable under this chapter;
         b.   Confined to company property or right of way; and
         c.   Cleaned up promptly.
      3.   Death of any person;
      4.   Personal injury necessitating hospitalization;
      5.   Estimated property damage, including cost of clean-up and recovery, value of lost product, and damage to the property of operator or others, or both, exceeding five thousand dollars.
   B.   An operator shall provide all of the following minimum information, to the extent known, when reporting any leak or spill:
      1.   The name of the individual reporting the leak or spill;
      2.   The name of the operator who has sustained the leak or spill;
      3.   The date and time of the spill or leak;
      4.   The date and time the leak or spill was discovered;
      5.   The date and time cleanup or remediation was commenced;
      6.   The location of the leak or spill, including all of the following information:
         a.   Facility, well name or lease name;
         b.   Quarter quarter quarter section;
         c.   Section number, township and range;
      7.   Identification of the material leaked or spilled, including any applicable MSDS information;
      8.   The volume of the leak or spill;
      9.   The volume of the leak or spill which was recovered including records from the operator who recovered the spilled or leaked material;
      10.   The remediation or cleanup measures taken;
      11.   The cause of the leak or spill; and
      12.   The distance from the leak or spill to the nearest city water well. (Ord. 449 (part), 2003)
