Any elected officer or subsequently appointed officer, shall take an oath of office or affirmation to support the constitution of the United States, the constitution and laws of New Mexico and faithfully perform the duties of his office. The governing body shall declare vacated the office of any person who fails, within ten days after he has been notified of his election or appointment to office, to take the oath of office.
