5.20.010   Approval of amusements, circuses and carnivals by city commission.
   Carnivals and circuses shall only be allowed in the city by resolution of the city commission upon consideration of appropriate applications and upon such further terms and conditions as the city commission, in its discretion, deems proper in the circumstances including but not limited to the following:
   A.   No person shall conduct, operate, manage or sponsor any Ferris wheel, merry-go-round or other mechanical device that carries or conveys passengers along, around or over a fixed or restricted route or course or within a defined area for the purpose of giving its passengers amusement, pleasure, thrills or excitement or for the business or for the purpose of promoting or advertising any trade or business, until the city clerk is furnished proof of compliance with New Mexico Carnival Insurance Acts and;
   B.   No authority shall be issued by the city until the city is furnished with:
      1.   Proof of insurance in an amount of not less than one million dollars against liabilities for injury to persons arising out of the operation of carnival rides, listing each ride by name and serial number;
      2.   A certificate of inspection of each ride, said inspection shall have been conducted within the previous twelve-month period;
      3.   Conformance with current fire codes and regulations dealing with circuses, carnival rides, arcades and amusement houses or equipment and approval of the fire department;
      4.   The applicant shall deposit with the city treasurer a cash bond in the sum of one thousand dollars, conditioned upon saving harmless of the city from any and all liabilities or causes of action, which might arise by virtue of the granting of a permit to the applicant and conditioned further that no damage will be done to the streets, sewers, trees or adjoining property and that no dirt, paper, litter or other debris will be permitted to remain upon the streets or upon any private property by such applicant. Such cash bond shall be returned to the applicant upon certification by the chief of police that all conditions of this chapter have been complied with;
      5.   The applicant shall pay to the city a fee in the amount of thirty-five dollars per day. The fee may be waived or reduced under circumstances deemed appropriate by the city commission. (Ord, 377, 1993)
