The Mayor is hereby authorized and directed to execute on behalf of the City of Los Angeles any deed necessary to effect a good and sufficient conveyance by said City of such right, title and interest in or to any real property referred to in Section 7.59 hereof as the Board of Pension Commissioners may have agreed to convey on behalf of said City, and the Mayor is further authorized and directed to execute on behalf of said City any and all reconveyances, notices and other documents, instruments, and papers of every nature which the Board of Pension Commissioners may, in its discretion, deem necessary to effectuate the terms and conditions of any agreement entered into by said Board affecting such property, or to protect or enforce any right, title or interest therein of said City, the Board of Pension Commissioners or the Fire and Police Pension Fund, and the City Clerk is hereby authorized and directed to affix the City seal to any and all of the same. Any such deed, reconveyance, document, instrument, notice or other paper shall, however, first be executed by the said Board of Pension Commissioners.

Notwithstanding any provisions of any ordinance to the contrary, no person shall erect any building or structure or establish any use on property within any railway right-of- way where railway service has been abandoned or discontinued within two years after such abandonment or such discontinuance of service, or within six years after the effective date of this ordinance, whichever is later, without a permit, license or certificate of occupancy authorized by the City Council in accordance with this article.

No applications for the issuance of a permit, license or certificate of occupancy for the use of property within any railway right-of-way shall be accepted until such application has been referred to the City Planning Commission. The Commission shall submit to the City Council a report and recommendation containing a finding as to whether the particular property or portion thereof is needed as a right-of-way for transportation or the movement of traffic and whether the size, location and accessibility is such that it can be used without conflict with the zoning regulations. The City Council may authorize the issuance of such permit, license or certificate of occupancy if it finds that such proposed use conforms to the zone in which the right-of-way is classified on the “Zoning Map” provided for in Section 12.04 of the Los Angeles Municipal Code, that the particular right-of-way is not needed for transportation or for the movement of traffic, and that such proposed use would not be contrary to the public interest and would not be hazardous to the public health, safety and general welfare.
