778.03 SUPPLEMENTAL STANDARDS FOR DESIGNATION.
   (a)   In reviewing an application for an Outdoor Refreshment Area, City Council shall consider the appropriateness of the proposed district with respect to the City of Lorain's General Plan and other comprehensive plans adopted by the City Planning Commission, as well as with respect to the proximity and extent of residential uses, the availability of offstreet parking, and crime statistics for the immediate area. There shall be a minimum buffer of 5,000 feet between Outdoor Refreshment Areas.
   Ohio R.C. 4399.18 applies to a liquor permit holder located within an Outdoor Refreshment Area in the same manner as if the liquor permit holder were not located in an Outdoor Refreshment Area.
   (b)   An Outdoor Refreshment Area may be expanded by any owner of property that desires to be included within an existing Outdoor Refreshment Area by making an application to amend the Outdoor Refreshment Area. The application shall be the same as Section 778.02 except for paragraph (a)(6) and if necessary, additional information shall be required.
   The applicant shall submit a statement to the City indicating that an expansion of an existing Outdoor Refreshment Area is in the best of interests of the citizens of Lorain and how the citizens will benefit, and a narrative and appropriate market or feasibility study, if necessary, that shows that an expansion of the Outdoor Refresment Area will not negatively impact the existing businesses within the area. The area to be included shall be of minimum sufficient size to increase the Outdoor Refreshment Area by a number evenly divisible by five (5) and shall be contiguous to the existing Outdoor Refreshment Area.
   The process for the approval of an application for expansion of an Outdoor Refreshment Area shall be the same as described in Section 778.02 Application Processing, and also must meet the Supplemental Standards for Designation described in Section 778.03.
