§ 52.01 INSURANCE DURING INSTALLATION; BACKFILLING.
   (A)   Insurance during installation; plan. Any user described above shall carry public liability and property damage insurance for the benefit of the city during the time of installation of the water line by the user; the plan for the water line including materials, pipe sizing, valves, meter boxes, lid covers, and meter pit must be approved by the city through its Superintendent of the Water Department.
   (B)   Backfilling requirement. If the user cuts any street or road in the city, the soil in the backfill shall be jetted with water and have a minimum of 27 inches of sand, 12 inches of rock, and 3 inches of blacktop as approved by the city, and the user shall furnish a cash bond for $100 conditioned on a proper repair and backfilling of the street as described above, which bond shall be kept by the city for a minimum of 6 months after the backfilling.
   (C)   Affirmative acts. The user must agree to the following affirmative acts on its part:
      (1)   Repair any breaks in the user’s line at the user’s cost;
      (2)   Pay for all water lost as a result of a break;
      (3)   Secure necessary State E.P.A. permits;
      (4)   Pay for cost of the meter, and the meter shall be installed at the tap of the city main; and
      (5)   The city and the user must both agree on any future taps of the water line installed by the user.
