ADOPTING ORDINANCES

ORDINANCE NO. 3087

   AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF ORDINANCES FOR THE CITY OF LITCHFIELD, MONTGOMERY COUNTY, ILLINOIS; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, EXCEPT AS EXPRESSLY PROVIDED; PROVIDING FOR THE MANNER OF AMENDING THE CODE OF ORDINANCES; AND PROVIDING WHEN THE CODE OF ORDINANCES SHALL BE EFFECTIVE

   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITCHFIELD, MONTGOMERY COUNTY, ILLINOIS, AS FOLLOWS:

   Section I. That a Code of Ordinances, consisting of Title I through Title XV, inclusive, is hereby adopted and enacted as the Code of Ordinances of the City of Litchfield, and shall be treated and considered as a new and original comprehensive ordinance which shall supersede all general and permanent ordinances passed by the City Council on or before December 10, 2004, except such as by reference thereto or expressly saved from repeal or continued in force and effect for any purpose. Inclusive with the Code of Ordinances hereby adopted is included the Table of Special Ordinances, Parallel References and Index.

   Section II. That all provisions of the Code shall be in full force and effect from and after December 10, 2004, and all ordinances of a general and permanent nature of the City of Litchfield, enacted on final passage on or before December 10, 2004, and not in the Code or recognized and continued in force by reference therein, are hereby repealed from and after the effective date of the Code, except as herein provided. That repeal shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance.

   Section III. That any and all additions or amendments to the Code, when passed in such form as to indicate the intention of the City Council to make the same a part thereof, shall be deemed incorporated in the Code so that the reference to the Code of Ordinances, City of Litchfield, Illinois shall be understood and intended to include such additions and amendments.

   Section IV. That 3 copies of the Code shall be kept and filed in the office of the City Clerk, preserved in looseleaf form. It shall be the express duty of the City Clerk, or someone authorized by that officer, to insert in their designated places all amendments or ordinances which indicate the intention of the City Council to make the same a part of the Code when the same have been printed or reprinted in page form, and to extract from the Code all provisions which may from time to time be repealed by the City Council. This copy of the Code shall be available for all persons desiring to examine the same and shall be considered the official Code of Ordinances of the City of Litchfield, Montgomery County, Illinois.

   Section V. That the City Council of the City of Litchfield, Montgomery County, Illinois further directs that the Code of Ordinances of the City of Litchfield, Montgomery County, Illinois be available for public inspection through the internet and shall cause the same to be made available to the public. It is expressly understood, however, that the official Code of Ordinances shall be the printed or reprinted pages as set forth in the printed version of the Code, copies of which will be kept at the City Clerk's office.

   Section VI. That in case of an amendment of any section of the Code for which a penalty is not provided, the general penalty provisions as provided in the Code shall apply to that section as amended or in case the amendment contains provisions for which a penalty, other than the aforementioned general penalty is provided in another section of the same chapter, the penalty so provided in the other section shall be held to relate to the section so amended, unless the penalty is specifically repealed therein.

   Section VII. It shall be unlawful for any person, firm or corporation of the city to change or amend, by additions or deletions, any part or portion of the Code, or to insert or delete pages or portions thereof, or to alter or tamper with the Code in any manner whatsoever which will cause a law of the City of Litchfield to be misinterpreted thereby. Any person, firm or corporation violating this section shall be punished as provided in the Code of Ordinances hereby adopted.

   Section VIII. That all ordinances or parts of ordinances in conflict herewith or with the Code of Ordinances adopted hereby are to the extent of such conflict repealed.

   Section IX. That this adopting ordinance shall be in full force and effect from and after its passage and approval as provided by law. Further provided that this Code of Ordinances shall be in full force and effect from and after December 10, 2004.

   Section X. That the Code of Ordinances of the City of Litchfield shall be printed an published in looseleaf form by order of the City Council of the City of Litchfield.
