11-6-3: OTHER VILLAGE COSTS:

All license or franchise grantees shall, within thirty (30) days after written demand therefor, reimburse the village as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” in relation to direct and indirect costs and expenses incurred by the village in connection with any modification, amendment, renewal or transfer of the license or franchise or any license or franchise agreement. 11-6-4: RESERVED COMPENSATION FOR PUBLIC WAYS:

The village reserves its right to annually fix a fair and reasonable compensation to be paid for the property rights granted to a telecommunications license or franchise grantee. Nothing in this chapter shall prohibit the village and a grantee from agreeing to the compensation to be paid for the granted property rights. (Ord. 96-2800, 7-15-1996)

11-6-5: COMPENSATION FOR VILLAGE PROPERTY:

If the right is granted, by lease, license, franchise or other manner, to use and occupy village property for the installation of telecommunications facilities, the compensation to be paid shall be fixed by the village. (Ord. 96-2800, 7-15-1996)

11-6-6: CONSTRUCTION PERMIT FEE:

Prior to issuance of a construction permit, the permittee shall pay a permit fee as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” equal to a flat fee or a percentage of the estimated cost of constructing the telecommunications facilities, whichever is greater, as certified by the applicant's engineer and approved by the village engineer. 11-6-7: ANNUAL FEES:

Unless otherwise agreed in a license or franchise grant agreement, each license or franchise grantee shall pay an annual license fee to the village as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures” as reimbursement for the village's costs in connection with reviewing, inspecting and supervising the use and occupancy of the public ways in behalf of the public and existing or future users. 11-6-8: CABLE FEES:

Cable television franchisees shall be subject to the franchise fees, payments and costs provided in chapter 5 of this title. (Ord. 96-2800, 7-15-1996)

11-6-9: OVS FEES:

Unless otherwise provided in a franchise agreement, all OVS systems and franchise grantees shall pay a fee to the village in relation to annual gross revenues, as established by Title 1, Chapter 20, “Fees, Fines, Insurance, Guarantees, and Regulatory Measures”, subject to the same regulations contained in section 11-5-20 of this title for franchise fees paid to the village by cable operators franchised to provide cable service within the village and for payment of any franchise costs, if applicable.
