ADOPTING ORDINANCE
ORDINANCE NO. 80-956
AN ORDINANCE ADOPTING THE VILLAGE CODE
OF THE VILLAGE OF LISLE, ILLINOIS
BE IT ORDAINED by the president and board of trustees of the village of Lisle, DuPage County, Illinois, an Illinois municipal corporation, as follows:
Section 1: From and after the date of passage of this ordinance, the village code of the village of Lisle, Illinois, prepared by Sterling Codifiers, Inc., under the direction of the governing body of the village, containing all ordinances of a general nature in effect at the time of such codification, shall be accepted in all courts without question as the official code and law of the village as enacted by the president and board of trustees.
Section 2: There is hereby adopted, as a method of perpetual codification, the loose-leaf type of binding together with the continuous supplement service, provided by Sterling Codifiers, Inc., whereby each newly adopted ordinance of a general and permanent nature amending, altering, adding or deleting provisions of the official village code is identified by the proper catchline and is inserted in the proper place in each of the official copies. Hereafter, each such new provision shall become effective upon the passage of the ordinance and the insertion of the proper replacement pages in the copies of the code, three (3) copies of which shall be maintained in the office of the village clerk, certified as to correctness and available for inspection at any and all times that said office is regularly open.
Section 3: All ordinances of a general nature included in this official village code shall be considered as a continuation of said ordinance provision and the fact that some of the provisions have been deliberately eliminated by the governing body shall not serve to cause any interruption in the continuous effectiveness of ordinances included in said official village code. All ordinances of a special nature, such as tax levy ordinances, bond ordinances, franchises, vacating ordinances and annexation ordinances shall continue in full force and effect unless specifically repealed or amended by a provision of the village code. Such ordinances are not intended to be included in the official village code.
Section 4: It shall be unlawful for any person, firm or corporation to change or amend by additions or deletions, any part or portion of such code, or to insert or delete pages or portions thereof, or to alter or tamper with such code in any manner whatsoever which will cause the law of the village to be misrepresented thereby.
Any person, firm or corporation violating this section shall be punished as provided in section 1-4-1 of the village code of the village of Lisle, Illinois.
Section 5: All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Ordinances of a general nature adopted subsequent to preparation of the village code of Lisle, Illinois by Sterling Codifiers, Inc. up to and including the date of adoption of this ordinance and not forwarded for inclusion in said code to Sterling Codifiers, Inc. shall remain in full force and effect. Three (3) copies attached to said code shall be maintained in the office of the village clerk certified as to correctness and available for inspection at any and all times that said office is regularly open and shall, as soon as may be practicable, be codified in the manner specified in section 2 hereof.
Section 6: This ordinance and the code adopted by the same shall be in full force and effect from and after its passage and approval in accordance with law, as printed and published in pamphlet form by order of the president and board of trustees.
Section 7: The validity or invalidity of any section, paragraph, clause, provision, term, phrase, sentence, segment or word of this ordinance shall in no way affect the validity or invalidity of any other section, clause, provision, term, phrase, sentence, segment or word of this ordinance. In the event any such section, paragraph, clause, provision, term, sentence, segment or word is held to be unconstitutional, invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of remaining portions of this ordinance or any part hereof. The corporate authorities hereby declared that they would have passed each section, paragraph, clause, provision, term, sentence, segment or word hereof, irrespective of the fact that any one or more of the sections, paragraphs, clauses, provisions, terms, sentences, segments or words, subsections or phrases are declared unconstitutional, invalid, ineffective or void.
