Sec. 16-65. - Authority to cut off water if improvement benefit assessment not paid.
(a)   Within forty-five (45) days after any annual improvement benefit assessment levied against any benefitted property pursuant to KRS 67A.871—67A.894 becomes delinquent, the commissioner of finance shall notify the owner of the delinquent property, by registered mail, that such nonpayment will result in cutoff of water service to the affected property ninety (90) days after the delinquent date unless such annual improvement benefit assessment, together with any penalties and interest, shall be paid. Within thirty-five (35) days after the first notice is mailed, the commissioner of finance shall send, by registered mail, to the owner of the delinquent property a second notice restating the information contained in the first notice and stating this to be a "final notice." Where the owner of the delinquent property is not the occupant of the property, the commissioner of finance shall send both the first and final notice to the occupant of the delinquent property, by mail, when he sends such notices to the owner of the delinquent property.
(b)   If the annual improvement benefit assessment remains delinquent ninety (90) days after the date on which it was delinquent, the commissioner of finance shall direct the Kentucky-American Water Company, or its successors, to cease delivery of water service to such premises until such time as it is notified to resume water service to such premises by the commissioner of finance.
(c)   Where the owner of the delinquent property is not the occupant of the property, the commissioner of finance is authorized to accept payment for the annual improvement benefit assessment from the occupant of the delinquent property.
