(a) The commissioner of public works is authorized to enter into agreements for terms of up to eighteen (18) months with property owners for the provision of garbage and refuse collection if:
(1) Their property is within the urban services boundary;
(2) Their property is not located in an urban services district providing garbage and refuse collection; and
(3) Private garbage and refuse collection is not available.
(b) The rate for the provision of garbage and refuse collection for each property within the urban services boundary which is not located within an urban services district providing garbage and refuse collection shall be $0.175 per one hundred dollars ($100.00) of the assessed value of the property per year. If garbage and refuse collection is provided for a fraction of a year, the above-mentioned rate shall be charged on a pro rata basis.
