Sec. 16-11. - Dumpster collection schedules.
(a)   The urban county government shall make a maximum of two (2) collections per week from each establishment having dumpster containers. If a dumpster is blocked by a vehicle or is obstructed in any other way which prohibits access to a dumpster, the division of waste management will return for this collection only if collection schedules allow. If more collections are needed by certain establishments, a service charge shall be made for each additional dumpster container collected. The amount of the charge for each additional dumpster container collected shall be fifty dollars ($50.00) and shall be adjusted each year on July 1 to account for changes in the Consumer Price Index for All Urban Consumers (CPI-U) as reported by the U.S. Department of Labor. Notice of the adjusted fee shall be provided by publication of the adjusted fee on the urban county government's website. No dumpster containers will be collected or emptied by the urban county government if its collection equipment is required to pass over a curb. Such containers shall be placed and located as directed by the director of the division of waste management.
(b)   A dumpster container will not be collected when in the opinion of the director of waste mangement the container is filled with special handling wastes, hazardous wastes or when the combined weight of the container and its contents is of such an excessive weight as to pose a threat to the proper functioning of the packer truck lifting equipment.
(c)   Establishments using dumpster containers shall ensure that the container is placed at a point that is reasonably accessible for the purpose of collection. Such point shall not be in any public street, alley or sidewalk, or upon any public property of any nature. Dumpsters in extremely difficult locations may not be serviced if in the opinion of the director of the division of waste mangement a better, safer and more accessible location exists upon the property. Establishments shall see that dumpster containers are maintained in good condition. Any container with ragged edges, serious rust problems affecting the strength of the container or broken sleeves will not be serviced by the urban county government. Formal notice of the required dumpster replacement will be given to property owners and/or tenants. Dumpster containers shall be cleaned as often as necessary by the owner/occupant to ensure that the container does not become malodorous and unsanitary.
(d)   Temporary placement of dumpsters on rights-of-way for restoration or demolition work requires a permit from the division of engineering. The urban county government will not service temporary dumpsters.
