Sec. 15-10.3. - Same—Application.
(a)   An application for a certificate of approval for a license to operate a model/talent business must be submitted, with a $70.00 nonrefundable application fee, to the department and be signed by each officer if a corporation, each partner if a partnership, each member if an association, or each trustee or fiduciary as applicable.
(b)   The commissioner is authorized to contract with an outside agency if deemed appropriate for services required to administer the provisions of these sections.
(c)   An initial application must contain:
(1)   The name and principal business address of the model/talent business;
(2)   Any other state or county registration numbers;
(3)   The address of each location at which the applicant for registration proposes to operate a model/talent business within Fayette County;
(4)   A description of the type of services offered;
(5)   A full and complete disclosure of any litigation relating to the operation of a model/talent business brought against the model/talent business or an owner, officer, or director that was completed within three (3) years before the date on which the statement is filed or is pending as of the date of filing. The model/talent business shall notify the department if a legal action relating to the operation of the business is subsequently brought against the business or an owner, officer or director. The business shall notify the department in writing not later than the tenth day after the date on which the defendant business receives notice of the action;
(6)   The complete names, social security numbers, dates of birth, addresses, and telephone numbers of all persons owning at least ten (10) percent of the model/talent business. If the model/talent business is a partnership, the above information for each partner must be included. If the model/talent business is a limited partnership, the above information for each general and limited partner must be included, along with the name and address of the registered agent. If the model/talent business is a corporation, the above information for the corporate president, vice president, secretary and treasurer must be included. The percent ownership interest must be stated in all cases;
(7)   The names of any model/talent business owners who have a financial interest in any company involved in the casting, production or distribution of motion pictures or television motion pictures, independent video production companies, recording studios, photography studios, or any other companies or firms which would hire models from time to time. This disclosure shall include the company or companies in which the owners have a financial interest, and the percent of ownership in each company listed;
(8)   The names of any model/talent business owners who have a financial interest in any school or course of instruction which is primarily intended for the professional study of acting or modeling. This disclosure shall include the school or course name and the percent of ownership held;
(9)   Bank and industry references; and
(10)   A schedule of commissions and/or fees charged.
(c)   If any information on the application changes, the model/talent business must forward a new application to the department within ten (10) working days of the change. A change in fees or commissions shall not be effective until it has been forwarded as required.
(d)   Each model/talent business shall keep a current copy of its fee and commission schedule available in each location where it conducts business. The model/talent business shall provide a customer who uses the services of the model/talent business, or is considering using the services of the model/talent business, a copy of the fee and commission schedule.
