(a) It shall be unlawful for any person to be in a condition of intoxication, excitement, giddiness, irrational behavior, depression, stupefaction, paralysis, unconsciousness, asphyxiation or other harmful or psychological condition as a result of the intentional inhalation or induction into his respiratory or circulatory system of any frequently abused volatile substance, or to possess or use a frequently abused volatile substance for the purpose of causing any such condition in himself or another person.
(b) It shall be unlawful for any person to sell, offer to sell, give, deliver or furnish or otherwise transfer any frequently abused volatile substance to any person under the age of eighteen (18) years unless such person is accompanied by his parent, legal guardian or other legal custodian, except when one (1) tube of glue and the amount of model paint and paint thinner necessary to complete a hobby or model kit is sold and delivered simultaneously with the sale and delivery of such a kit.
(c) It shall be unlawful for any person to display for sale any frequently abused volatile substance without first providing a sign or plaque in such display area warning all potential users that such substances can be dangerous to an individual's health if inhaled.
(d) It is a defense to prosecution under subsection (b) of this section that the seller, deliverer or transferor was actively misled or deceived by the presentation of a written or printed information presented by a person under the age of eighteen (18) years, relating to the age of identity of such person.
