It is hereby made illegal for any person to carry on in the urban county an endless chain retail merchandising store or business. An endless chain retail merchandise business is defined to be one where a dealer sells to a customer, for a certain sum, merchandise or service under the terms of a main contract with supplementary coupon contracts attached, each of a stated value, such main contract authorizing the customer to sell the supplemental coupon contracts at the stated value and giving each purchaser of a coupon contract, in turn, the right to apply to the dealer and buy merchandise or service under a contract similar to the main one, and to receive similar coupon contracts as did the first purchaser from the dealer; and so on in an endless chain; it being provided in the main contract that when any customer has signed a contract and has sold one (1) or more of the coupon contracts, each to different individuals, as above stated, such customer is entitled to an allowance or rebate to the value due under his contract, for each person to whom a coupon is sold, when that person applies to and enters into a similar contract with the dealer.
Any person, or his agents or employees, who shall violate the provisions of this section shall be deemed guilty of an offense, and upon conviction thereof shall be fined not less than five dollars ($5.00) nor more than fifty dollars ($50.00) or confined in the urban county detention center for not less than ten (10) days nor more than thirty (30) days, either or both penalties to be inflicted in the discretion of the court; the sale of each main contract being a separate offense.
